'RH & Co. IT Services also trading as RHC Hosting' or ‘us’ or ‘we’ refers to the owners of this website. The term ‘you’ or 'client' or 'customer' refers to the reader of the content of this website or the service buyer. By subscribing to our shared or dedicated hosting services, you are agreeing to comply with and be bound by the following Terms and Conditions of use, which together with our Privacy Policy and Acceptable Use Policy govern our relationship with you in relation to this website and the services we provide.

1 - The content of the pages of this website is for your general information and use only. It is subject to change without notice.

2 - Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for such errors to the fullest extent permitted by law.

3 - Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

Some of these websites are either built, maintained or hosted by us, however, we shall in no circumstances be held responsible for any copyright issues related to the content (text or images) appearing on these websites. 8 - Our web hosting packages are offered to the customer based on the hardware and software ordered. We aim to provide the latest available Operating Systems (inc. patches and updates) unless otherwise explicitly requested by the customer.

9 - In the very unlikely event that a hardware should fail, we aim to replace the failed device (after we made intensive checks) at our own expense and no money will be charged to the customer

10 - Servers which require additional IP addresses will be upgraded free of charge (ie : Additional RAM / Upgraded Processor or NIC where necessary).

11 - Additional IP addresses are requested on behalf of the customer and the information provided by the customer will be passed on to the relevant authorities who will decide if the allocation should be authorised or not. IP addresses will then be the property of the customer for the period paid for.

12 - We provide flexible pricing to our customers and there's no minimum contract, however should the customer decide to cancel their service before the expiry date and past the notice period of 7 days, a cancelation fee of $29 (for dedicated servers only) will be applied.

13 - The customer is the sole entity responsible for its server/hosting package, its content and the use of it. We therefore recommend doing regular backups as well as software updates and install a firewall for protection against DDOS and other port scans (dedicated servers and vDS only).

14 - Unless you have subscribed to one of our backup servers, additional recovery costs will apply in the unlikely event something goes wrong due to your activities. If a hardware failure is the cause, no costs will be applied.

15 - If a customer uses our servers for mailing purposes, we highly recommend following the Anti Spam Guidelines and complying with the new GDPR. Emails for marketing purposes should ONLY be sent to customers who have explicitly expressed their willingness to accept such emails. Any email volume at or above a level of 200 per week is considered bulk emailing.
For bulk emailing purposes, any server or customer who receives more than 5 complaints per month is considered a spammer and will have its account and server terminated and reported to the relevant authorities. Whilst our IP ranges are provided whitelisted they should be returned in the same state. A refundable deposit may be required before allocating IP adresses, which will cover delisting charges.

•  We investigate all emails complaints and we will terminate and report any customer who is clearly using our network to send UBE. If we have reasons to believe the listing was not intentional, we may contact the customer in order to resolve any issues prior to taking further actions - it is therefore imperative that the details supplied when registering or ordering our services are current and kept up-to-date.

•   A server may be shutdown in the event its IP / block of IP appears to be blacklisted or we receive a substantial amount of complaints. In such event, the data contained in the server will be lost if no previous backup has been taken - We will not liable for any damages or inconvenience caused.

•   A Spamhaus listing (whichever the cause) will lead to the immediate suspension of the server and the ban of the customer from using our services.

The above rules have been put in place to protect us and our Networks from leechers/ miners / P2P and Spammers.

16 - All provided IP addresses are thoroughly checked against major Real-time Black and Grey Lists before being assigned to the customer. We therefore cannot be held responsible if the actions of the customer have lead or will lead to the server being blacklisted.
However, depending on individual cases and stock availability, we may provide additional IPs free of charge providing that the customer makes a legal and legitimate use of his server.

17 - a) Additional IP addresses will be allocated to customers for legitimate use only (Reseller Hosting / SEO / Genuine and Double Opt-in Email Marketing...). Due to abuse, an IP Justification Request Form will need to be duly filled, signed by the customer and sent back to iprequest@rhc-hosting.com before any allocation can take place. 17 - b) RHC Hosting reserves the right to charge the lesee administrative, processing, abuse management, cancelation or penalty fees for: • Tasks we may perform outside the normal scope of our services,
• Additional time or cost we may have incurred,
• Recovering losses arising from non compliance to our AUP,
• Handling of complaints related to violations of our ToS,
• Manual incident mitigation
The incident handling fee varies between $49 to $500 per incident depending on its type, reoccurence and severity. An invoice will be to the registered invoice address following the incident.
Failure to make payment for the above may lead to your details being passed to law enforcement agencies, debt collectors and you will be reported accordingly to our anti-fraud partners. We will also not fulfill any future orders.

18 - All Hosting packages are provided with the basic software and modules allowing the customer to run basic and advanced websites (Ioncube, Zend framework, PHP...)

All Dedicated packages are provided 'raw' which means basic software (SSH for Linux) and updates are installed on delivery.
Installation and / or configuration of additional products can be made at an additional cost. Please contact us for more details and pricing.

19 - Minimum Contracts

a) Shared hosting, dedicated and cloud servers have no minimum contract period - meaning the contract can be canceled by the customer at any time after the date of activation.

b) Colocation and rackspace have a 3 months minimum contract period

20 - Bandwidth and Fair usage for all packages
All shared hosting packages come with limited bandwidth. If you think you will need more than 10 TB of Bandwidth, please contact us before placing your order otherwise additional bandwidth costs will be applied

Customers shall only use our hardware for lawful purposes. In order to protect our customers and network, the following unlawful content is forbidden accross the whole RHC Hosting Network. This includes (but not limited to) :
=> Torrent / P2P / Bitcoin Mining
=> Sites permitting or supporting illegal activites, racial, cultural, sexual or religious discrimination
=> Hosting and/or distributing pirated software or multimedia / copyrighted material / cracks / warez etc...
=> Transmission, Processing or Storage of any material violating any Federal, National or Local regulation


21 - Any package which causes huge stress to our infrastructures or encouraging torrents/p2p, spamming and any other illegal activity will be immediately terminated. Customers using our network or servers for such activities will be reported to the relevant agencies

22 - Any suspended service due to the reasons mentioned in .21 will not be refunded.

23 - Invoices are usually sent 7 days before the due date. If payment is not received 3 days after the due date, the server or hosting package is frozen. 5 days after the grace period, all data is erased and lost. During holiday periods, we may require at our own discretion an earlier or later payment of the due invoice(s).

24 - If the customer cannot pay before the due date for personal reasons and wishes to carry on its services to the next month, a late-payment fee of $24.99 (dedicated and cloud servers) or $14.99 (mail and hosting) will be applied to the account. If an automatic payment has been suspended, it will be re-enabled for the following month.

25 - To prevent fraud, refunds can only be made to the verified and same original payment method - When this cannot be done (ie : crypto payments), a refund to the account credit will be made. In which case, customer can either use it for future services or request a widthdrawl after 90 days.

26 - You may not create a link to this website from another website or document without our prior written consent.

27 - These Terms and Conditions apply to all current and future customers and do not affect your statutory rights.

28 - None of the text or images in this website may be copied and/or edited without the expressed written consent of its authors.

29 - These Terms and Conditions are subject to change without notice.
